Project Issues

David Wilson Homes wanted to claim for the costs incurred when a land slip took place at the rear of their new development; Manor Park Newbury. Advice provided by the defendant Engineer regarding land embankment and drainage design failed to include land drainage at the top of the embankment. This lack of information and heavy rainfall resulted in remedial work required to complete the works and therefore increased costs and time to our client.

Our Approach

Lindford Consulting was instructed by the Instructing solicitor to produce a Quantum Expert Report, initially for the purposes of a Pre-action Protocol and if no resolution was sought; formal proceeding. Having received the factual information arising out of the claim, Edward Carolan (appointed Expert) prepared a detailed analysis of the remedial work, including quantifying the amount of work undertaken and subsequently valuing the works. Following the Quantum analysis Edward produced a Quantum Expert Report of the findings and his quantum assessment of the value of the remedial work.

The Outcome

Following the submission of the Expert Report, further negotiations took place between the parties and an amicable settlement was reached. The rigorous method of quantifying and valuing the remedial works, together with Edwards’s independent and impartial approach ensured a very satisfactory outcome for our client.
